The Constitution consists of the VII original Articles along with the Bill of Rights that consists of 27 Amendments. Principles of the Constitution include checks and balances, individual rights, liberty, limited government, natural rights theory, republican government, and popular sovereignty. Thirteen States ratified the Constitution to include The Bill of Rights. The Bill of Rights were created specifically to protect the rights of the people.

For Example: The Eighth Amendment states: “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
If a 21-year-old with marijuana in her system gave birth to a child with THC in his or her system, should the child be taken away because the mother was under the legal age to smoke marijuana? In addition to the child being taken away, the mother is put on the Child Registry for Abuse for 25 years and future children taken. The child is then placed with a stranger indefinitely, instead of with biological family.
The child’s vitality is reduced to a 40% chance of early death, incarceration, or homelessness. This happens because of separation from the parents and biological family. Does the mother’s crime fit the punishment, or would this be considered cruel and unusual punishment for both the mother and the child?
DCS cases are primarily for Neglect cases (Abuse 9% and Neglect 91%). Neglect cases are even more questionable as it relates to the Bill of Rights, when the outcomes are the same—for criminal allegations for a parent’s medical condition, domestic violence, overnight incarcerations, poverty, accidental injuries, spankings, etc.
It is a good time to refresh your mind regarding your Bill of Rights.
